This is the easiest way to start the process and avoids any perceived conflict of interest arising from one of the parties feeling like the other party contacted us first and thus has some sort of advantage. We can assure you that Premier Dispute Resolution does not care which party contacted us first regarding mediation and assures you that his mediations are always neutral. We have intentionally kept the following Mediation Inquiry Form very generic so that parties do not provide their positions or arguments until the mediation itself.
Once we receive your Mediation Inquiry Form, we will run a conflict check to confirm that neither Premier Dispute Resolution or any of our attorneys have consulted with or represented either party in the past. Assuming there is no conflict, we will then contact both parties at the same time (i.e. generally by joint email) to schedule the introductory session.
Although we can discuss procedural matters such as scheduling with you, we cannot discuss the facts of your case and your individual positions outside of the other party’s presence before the mediation (with the exception of your confidential mediation memos or letters and exhibits that you may wish to present just before the first mediation session).
